These Terms of Service (“Agreement”) set forth the legally binding terms for your use of the Services. By accessing or using the Services, you are accepting this Agreement and represent and warrant that you have the right, authority, and capacity to enter into this Agreement. If you do not agree with all provisions of this Agreement, do not access or use the Services. You may not access or use the Services if you are under 18 years old.

Privacy Policy

We respect the privacy of our Service users. Please refer to our Privacy Policy, linked in the footer of our websites, which explains how we collect, use, and disclose information relating to your privacy. By accessing or using the Services, you signify your agreement to our Privacy Policy.

If you access our Services from outside the United States, you consent to the processing of your data in the United States in accordance with our Privacy Policy.

Communications Consent

By creating an account, making a purchase, or otherwise providing your contact information, you agree to receive communications from Evolve Your Wedding Business LLC, including email, SMS/text messages, and automated messages through our Messenger bot, in accordance with our Privacy Policy.

SMS/Text Messaging

Evolve Your Wedding Business SMS Alerts are operated in compliance with applicable telecommunications laws, carrier requirements, and industry standards, including the Telephone Consumer Protection Act (TCPA). By opting in, you acknowledge and agree to the following:

  • Consent – You will only receive text messages after providing explicit consent through our forms, checkout, or other enrollment methods. Opt-in requests clearly state the types of messages you will receive, how often, and how to opt out.

  • Opt-Out – You may cancel SMS messaging at any time by replying STOP. After sending STOP, you will receive a final confirmation message, and no further SMS messages will be sent unless you opt in again.

  • Rejoining – If you unsubscribe and later want to rejoin, you must opt in again through our form or other enrollment method.

  • Message Content – Messaging is limited to updates, reminders, promotions, and other business-related content. We do not send unlawful, offensive, or misleading content.

  • Carrier Disclaimer – Wireless carriers are not liable for delayed or undelivered messages.

  • Data Use – Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the Text Message services.

Accounts

Account Creation. In order to use certain features of the Services, you may need to register for an account (“Account”) and provide certain information. You represent and warrant that: (a) all required registration information you submit is truthful and accurate; and (b) you will maintain the accuracy of such information. You may delete your Account at any time by following the instructions on the Sites. We may suspend or terminate your Account in accordance with these Terms.

Account Responsibilities. You are responsible for maintaining the confidentiality of your Account login information and are fully responsible for all activities that occur under your Account. You agree to immediately notify us of any unauthorized use, or suspected unauthorized use, of your Account or any other security breach. We cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

Membership Payment Terms

Subscriptions, Programs, and Billing. Certain aspects of the Services may be provided for a fee, subscription, or other charge. Subscription-based services automatically renew at the end of each billing cycle, typically every thirty (30) days, at which point you will automatically be charged for the next cycle. We may add new services or amend fees at our sole discretion. Changes to pricing or payment terms will be effective in the billing cycle following notice to you.

Payment Information; Taxes. You are responsible for all fees, including taxes, associated with your use of the Services. You must provide accurate and current payment information. You agree to pay all charges incurred using your chosen payment method.

Payment Authorization. By agreeing to these Terms, you authorize us to charge your on-file payment method for any authorized fees.

Chargebacks. If you dispute a payment with your bank or card issuer (“Chargeback”), this will be considered a breach of your payment obligations. We reserve the right to terminate your access and to dispute the Chargeback. To resume Services after a Chargeback, you must re-subscribe and pay all fees, including any costs incurred by us or our payment processor.

Recurring Payments. By joining as a monthly “cancel any time” member, you understand that your payment method will be charged each month on your subscription anniversary date until you or we cancel your membership.

Financial Obligation. You are responsible for completing all payment plans associated with your purchases. We reserve the right to pursue recovery of unpaid amounts through a collection agency.

Pausing Subscriptions. Subscriptions cannot be paused.

Refund and Return Policy

Membership Types

Free or Paid Trial: Requires payment details. At the end of the trial, unless you cancel, your payment method will be charged the full membership fee. No refunds are given.

Monthly “Cancel Any Time”: Renews automatically every 30 days. You may cancel anytime through your account. Access continues until the end of the billing period.

Annual: Valid for 365 days. Payment may be made in full or installments.

Lifetime: Valid for the life of the product. We reserve the right to discontinue any product or service at any time.

Cancellation. You may cancel at any time by emailing heidi@evolveyourweddingbusiness.com. Payment plans cannot be cancelled mid-term. Services remain active until the end of the billing cycle.

Termination of Membership

Membership may be terminated at any time for failure to comply with these Terms. Upon termination, you must cease representing yourself as a member and delete or destroy any information obtained from the membership.

Rights and Licenses

We grant you a limited, non-transferable, non-exclusive right to use the Services for personal purposes. Restrictions apply, including prohibitions on resale, reverse engineering, and unauthorized reproduction.

User Content & Acceptable Use

You are solely responsible for the content you post. You may not post unlawful, harmful, or infringing content. We reserve the right to remove any User Content at our discretion.

Feedback

Any feedback or suggestions you provide may be used by us without restriction or compensation.

Indemnity

You agree to indemnify and hold us harmless from claims arising out of your use of the Services, your User Content, or your violation of these Terms.

Links to Third-Party Sites

We may link to third-party sites or services. We are not responsible for those third parties or their content.

Release

You release us from claims arising out of your interactions with other users or third-party sites.

Disclaimers

The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

Limitation on Liability

Our liability to you will not exceed the amount you have paid us in the prior 12 months. We are not liable for indirect or consequential damages.

Term and Termination

This Agreement remains effective while you use the Services. We may suspend or terminate your access at any time.

Copyright Policy

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). Notices of alleged infringement should be sent to:

Legal Disputes

Disputes will be resolved through binding arbitration in San Diego County, California, unless you qualify for small claims court. Class actions are prohibited.

General

We may revise these Terms from time to time. Changes will be effective 30 days after notice is posted. Continued use of the Services constitutes acceptance of revised Terms.

Anti-Racism Policy

We are an anti-racist company. Any discriminatory actions or content will result in immediate termination of your access without refund.
